New Delhi: In a significant development, the Court of the Learned Additional Sessions Judge (Fast Track Court) at Patiala House Courts has discharged the accused in a case registered under Section 376 of the Indian Penal Code arising out of FIR No. 91/2024.

The order, dated 12 March 2026, was passed after the court heard arguments on the point of charge. The Hon’ble Court observed that the material placed on record did not disclose the level of “grave suspicion” required for framing charges against the accused.
The defence team was led by Advocate Harish Kaushik and Advocate Maneesh, along with Himanshi, Himanshu Kaushik, and Mohsin, who presented detailed submissions during the hearing. The defence argued that the material available on record did not legally justify proceeding to trial.
After examining the case records and hearing submissions from both sides, the Court concluded that the prosecution had failed to cross the legal threshold necessary for framing charges. Accordingly, the accused was discharged under Section 227 of the Code of Criminal Procedure.
Speaking on the development, Advocate Maneesh stated that the order underscores the importance of careful judicial scrutiny at the stage of framing charges, reiterating the legal principle that criminal proceedings should proceed only when sufficient material exists to warrant a trial.
The decision was delivered after the Court considered the entire case record and the legal principles applicable at the stage of charge.
